3. Site Access

The Site is in principle accessible 24 hours a day, 7 days a week. Drive & Taste SL nevertheless reserves the right to interrupt access, without prior notice or compensation, in particular for maintenance, updates, security reasons, or any other technical or legal ground.

The user is solely responsible for the hardware and software required to access the Site, as well as the associated connection costs.

4. Intellectual Property

All elements comprising the Site — including texts, photographs, videos, graphics, logos, icons, sounds, software, layouts, databases, visual identity and site architecture — are the exclusive property of Drive & Taste SL or its licensors, and are protected by applicable intellectual property law, in particular Andorran law and the international conventions to which the Principality of Andorra is party.

Any reproduction, representation, modification, publication, transmission, adaptation, translation, commercial exploitation or distribution, in whole or in part, by any means and on any medium, without the prior written authorisation of Drive & Taste SL, is strictly prohibited and constitutes an infringement that may give rise to civil and criminal liability.

Trademarks, trade names, logos and distinctive signs appearing on the Site and belonging to third parties remain the exclusive property of their respective owners. Their appearance on the Site confers no right of use upon third parties.

5. Liability

5.1 Site Content

Drive & Taste SL takes reasonable measures to ensure the accuracy, currency and quality of the information published on the Site. Information is provided for guidance purposes only and without any express or implied warranty. Drive & Taste SL cannot be held liable for any inaccuracies, omissions or errors, nor for any direct or indirect consequences that may result.

Photographs, service descriptions, itineraries, partners, accommodation, vehicles and prices presented on the Site are indicative and subject to change. Only the terms set out in the contractual documents signed between Drive & Taste SL and the client shall be binding.

5.2 Use of the Site

The user acknowledges using the Site at their own risk. Drive & Taste SL shall not be held liable for:

· temporary or permanent interruption of access to the Site; · malfunctions, bugs or technical errors; · incompatibility with the user's hardware, software or browser; · the possible presence of viruses, malware or other harmful elements whose propagation is attributable to a third party; · any direct or indirect, material or immaterial damage resulting from the use of the Site or the inability to use it.

5.3 Force Majeure

Drive & Taste SL shall not be held liable in the event of a force majeure event rendering the performance of its obligations or the availability of the Site impossible or significantly impaired.

6. Personal Data Protection

6.1 Data Controller

6.2 Data Collected and Purposes

Drive & Taste SL collects and processes the following categories of data for the purposes and on the legal bases set out below:

6.3 Recipients of Data

Data is intended for the internal teams of Drive & Taste SL. It may be shared, strictly to the extent necessary for the purposes described, with:

· technical service providers (hosting provider, emailing tools, commercial management tools, payment processors); · operational partners (hotels, restaurants, automotive service providers) for the proper performance of contracted services; · administrative, tax or judicial authorities upon lawful request.

Drive & Taste SL does not sell or transfer personal data to third parties for commercial purposes.

6.4 Retention Periods

· Commercial prospecting data: 3 years from the last contact initiated by the prospect; · Client data: duration of the contractual relationship, plus 5 years from the last service rendered; · Accounting and tax data: 10 years in accordance with applicable legal obligations; · Connection data and cookies: maximum 13 months.

6.5 Transfers Outside the European Economic Area

The Principality of Andorra benefits from an adequacy decision by the European Commission (Decision 2010/625/EU of 19 October 2010) recognising an adequate level of protection for personal data. Transfers of data from the EEA to Drive & Taste SL in Andorra are therefore lawful under the GDPR.

No transfer of data to a third country that does not benefit from either an adequacy decision or appropriate safeguards is carried out without first informing the data subject.

6.6 Rights of Data Subjects

In accordance with Regulation (EU) 2016/679 of 27 April 2016 (GDPR) and the Llei 29/2021, del 28 d'octubre, qualificada de protecció de dades personals (Andorran data protection law), every individual has the following rights:

· right of access to their data; · right to rectification; · right to erasure ("right to be forgotten"); · right to restriction of processing; · right to object; · right to data portability; · right to withdraw consent at any time, without affecting the lawfulness of prior processing; · right to define instructions regarding the fate of their data after death.

6.7 Complaint to a Supervisory Authority

Any person who considers that the processing of their data does not comply with applicable regulations may lodge a complaint with:

· the Agència Andorrana de Protecció de Dades (APDA) — www.apda.ad; · or the supervisory authority competent in the place of the data subject's habitual residence, in particular, for French residents, the Commission Nationale de l'Informatique et des Libertés (CNIL) — www.cnil.fr.

6.8 Security

Drive & Taste SL implements appropriate technical and organisational measures to ensure a level of security appropriate to the risk, and in particular to protect data against any unauthorised access, disclosure, alteration or destruction.

7. Cookies

7.1 Definition

A cookie is a small file placed on the user's device when browsing the Site, used to store and read information relating to their navigation.

7.2 Categories of Cookies Used

The Site may use the following categories of cookies:

11. Governing Law and Jurisdiction

This legal notice is governed by Andorran law.

Any dispute relating to its interpretation, validity or performance shall, failing prior amicable resolution, be submitted to the exclusive jurisdiction of the courts of the Principality of Andorra.

These provisions apply without prejudice to the mandatory consumer protection rules recognised in the country of habitual residence of the user when acting as a consumer within the meaning of applicable law.
